USB14-0403. Establishment and membership of Board. Amend. This amendment reduces the size of the MCLE Board from 15 to 10 voting members. This amendment also adjusts the term lengths of new appointments to the Board.

The Supreme Court Board of Mandatory Continuing Legal Education is proposing changes to the MCLE Rules that govern licensed attorneys. For more information, please see the attached letter from David Hirschi, Chair MCLE Board.

USB14-0403. Proposed changes to the rule make the appointment and term durations for MCLE Board members consistent with the Rule 11-101 appointment and term durations for members of other Court committees. Effective June 20, 2018 pursuant to CJA Rule 11-105(5), expedited rulemaking.

The proposed rules apply to Licensed Paralegal Practitioners. Rule 14-403 amends the membership of the MCLE Board to permit up to 2 Licensed Paralegal Practitioners to serve on the MCLE Board. Rules 15-401 through 15-417 create continuing education requirements for Licensed Paralegal Practitioners that are similar to the MCLE Rules for attorneys. The rules require 12 hours of continuing education every two years which must include three hours of ethics and professionalism. The licensed paralegal practitioner is required to use the same certification process used by attorneys at the end of the two-year cycle to certify they have attended the appropriate CLE courses.

The following proposals address changes to the MCLE rules. The most substantive proposed change allows lawyers to receive up to six hours of live continuing legal education credit for attending live, interactive webcasts that are broadcast from a Utah state courthouse to a Utah state courthouse or from the Law and Justice Center to a Utah state courthouse. The proposals also address the requirements for active Bar members living outside of Utah and practicing in other jurisdictions. The majority of the changes correct grammar and inconsistencies with other Bar rules, as well as provide clarification.
