Rules of Juvenile Procedure – Comment Period Closed October 13, 2023

URJP009. Detention hearings; scheduling; hearing procedure. Amend. The proposed amendments to Rule 9 include the addition of paragraph (o) allowing the juvenile court to review predisposition orders to detention every 30 days instead of every 7 days when there is concurrent jurisdiction in the district and juvenile courts or when a criminal information is pending in the juvenile court. The changes also include replacing the language “shall” with “must” or “will” to comply with the Supreme Court Style Guide.

URJP010. Bail for non-resident minors. Amend. The proposed amendments to Rule 10 include updating references to statute.

Rules of Juvenile Procedure – Comment Period Closed – May 29, 2020

URJP009. Detention hearings; scheduling; hearing procedures.  Amended. Makes revisions to comply with statutory changes to 78A-6-112 and 78A-6-113 and brings rule in compliance with H.B. 384-Juvenile Justice Amendments (2020) and prior juvenile justice reforms.  The revisions place restrictions on the amount of time and the conditions under which the minor may be held in detention.  Requires a court determination of grounds for admission within 24 hours including weekends and holidays. Revises standard from reasonable basis to probable cause.   Deletes the Advisory Committee Note.

URJP032.  Initiation of ungovernability and runaway cases.  Amended. Revised to reflect that petitions related to children who are ungovernable or are runaways may only be filed by the Division of Juvenile Justice Services pursuant to statutory changes contained in S.B.65-Child Welfare Amendments (2020).

Makes revisions to comply with statutory changes to 78A-6-112 and 78A-6-113.  The revisions place restrictions on the amount of time and the conditions under which the minor may be held in detention.  Requires a court determination of grounds for admission within 24 hours including weekends and holidays.  Deletes the Advisory Committee Note.  [Note: The Advisory Committee is continuing its discussion on whether the appropriate standard in the rule should be reasonable basis, reasonable grounds or probable cause and may address this question in a separate rule revision at a later date.]

Rules of Juvenile Procedure – Comment Period Closed April 28, 2019

URJP009. Detention hearings; scheduling; hearing procedure. Amended. Clarifies that the findings made at the time a minor is held in detention are not also required if the court determines instead that a minor should be released.

URJP032. Initiation of ungovernability and runaway cases.  Amended. Revised to reflect that the rule applies to children and not minors and to mirror the language of Section 78A-6-103(3).

Rules of Juvenile Procedure – Comment Period Closed February 4, 2019

URJP009. Detention hearings; scheduling; hearing procedures.  Clarifies conditions under which a minor may be held in detention and deletes the Advisory Committee Note.

URJP027A. Admission of statements given by minors.  Revised to delete paragraph (a)(2) due to concerns that the language may unconstitutionally shift the  burden to a juvenile to show that the juvenile did not knowingly and voluntarily waive his or her rights. Also deletes the Advisory Committee Note.

Rules of Juvenile Procedure – Comment Period Closed July 22, 2018

URJP005. Amended.  Makes revisions to the definition of “ungovernability” to comply with statutory changes, which become effective July 1, 2018.  Corrects references to “child” rather than “minor.”

URJP09. Amended.  Makes revisions to comply with statutory changes to 78A-6-112 and 78A-6-113, which will become effective July 1, 2018.  The revisions place restrictions on the amount of time and the conditions under which the minor may be held in detention.

URJP011. Amended.  Clarifies that a request to extend the time period for filing a petition related to a detention order shall be made specifically by motion rather than merely “a separate written request.”  Eliminates outdated language regarding court forms.

URJP018. Amended.  Adds the term “parents” to make the language of the rule consistent with 78A-6-109.

URJP058. Amended.  Adds a reference to Chapter 37 to the statement “the court shall honor the rights and procedures accorded to victims pursuant to Title 77, Chapters 37 and 38, Victims Rights.”
