Rules Governing the Utah State Bar – Comment Period Closed June 2, 2019

CJA14-0515. Access to disciplinary information. Amend. Currently, Rule 14-515 requires all parties to a discipline action to maintain confidentiality prior to the filing of a formal complaint or the issuance of a public reprimand. The amendments to Rule 14-515 clarify that the confidentiality requirements do not apply to the complainant.

Rules Governing the Utah State Bar – Comment Period Closed May 5, 2019

USB14-0301. Standards of Professionalism and Civility. Amend. Provides that a lawyer shall avoid hostile, demeaning, humiliating, intimidating, harassing, or discriminatory conduct with all other counsel, parties, judges, witnesses, and other participants in the proceedings.

This rule coordinates with Rule 8.4 of the Utah Rules of Professional Conduct.

Rules Governing the State Bar

USB14-0802. Authorization to practice law. The amendments to Rule 14-802 clarify that the forms an LPP may use are forms approved by the Judicial Council.

Rules Governing Licensed Paralegal Practitioners

URGLPP15-0510. Prosecution and appeals. The amendment to Rule 15-510 changes a cross reference to Standing Order No.7 to a cross reference to Rule 14-303.

Licensed Paralegal Practitioners Rules of Professional Conduct

LPP1.013. Organization as a client. Rule 1.13 is repealed because it governs when an LPP represents an organization as a client and an LPP may not represent an organization as a client.

LPP5.04. Professional independence of a licensed paralegal practitioner and LPP6.01. Voluntary pro bono legal service.

The amendments to Rules 5.4 and 6.1 remove language that refers to an LPP representing an organization as a client. An LPP may not represent an organization as a client.

USB14-0302. Definitions. New. This is part of an effort to codify Standing Order No. 7, which established a program of professionalism counseling for members of the Utah State Bar. This rule provides the definitions used in Rule 14-303.

USB14-0303. Professionalism and Civility Counseling. New. This is part of an effort to codify Standing Order No. 7, which established a program of professionalism counseling for members of the Utah State Bar. This rule provides for the composition of the Professionalism and Civility Counseling Board, the Board’s authority and responsibilities, and the procedures surrounding the submission and resolution of complaints.

USB14-0510. Prosecution and appeals. Amend. Updates references to Standing Order No. 7 to new Rule 14-303.

Rules Governing the State Bar – Comment Period Closed December 16, 2018

USB14-0804. Certification for military legal assistance lawyers. Amend. Updates the standards for military lawyers who are allowed by military and federal law to assist certain persons who can receive military legal assistance.

USB14-0805. Admission for spouse of active military stationed in Utah. New. Allows spouses of servicemen and women who are stationed in Utah to serve as practicing lawyers under certain conditions.

Rules Governing the State Bar – Comment Period Closed November 10, 2018

USB14-0806. Proposed amendments more accurately describe pro hac vice application requirements. Changes also increase the application fee to the fee equal to the annual licensing fee by paid active members of the Utah State Bar and require pro hac vice admittees to pay an annual renewal fee for each year the pro hac admitee continues to act as counsel in the cause.

Rules Governing the State Bar – Comment Period Closed August 11, 2018

USB14-0403. Proposed changes to the rule make the appointment and term durations for MCLE Board members consistent with the Rule 11-101 appointment and term durations for members of other Court committees. Effective June 20, 2018 pursuant to CJA Rule 11-105(5), expedited rulemaking.

Rules Governing the State Bar and Rules Governing Licensed Paralegal Practitioner – Comment Period Closed May 20, 2018

The proposed rules apply to Licensed Paralegal Practitioners. Rule 14-403 amends the membership of the MCLE Board to permit up to 2 Licensed Paralegal Practitioners to serve on the MCLE Board. Rules 15-401 through 15-417 create continuing education requirements for Licensed Paralegal Practitioners that are similar to the MCLE Rules for attorneys. The rules require 12 hours of continuing education every two years which must include three hours of ethics and professionalism. The licensed paralegal practitioner is required to use the same certification process used by attorneys at the end of the two-year cycle to certify they have attended the appropriate CLE courses.

Rules Governing the State Bar – Comment Period Closed May 6, 2018

USB14-0409 Amend. Self-study categories of accredited MCLE defined. Proposed changes to the rule allow up to nine (9) hours of self-study CLE credit during a compliance period for lawyers who lecture on legal topics in community outreach programs.

USB14-0413 Amend. MCLE credit for qualified audio and visual presentations, webcasts, computer interactive telephonic programs, writing, lecturing’ teaching, live attendance. Proposed changes to the rule state the hours and types of credit that are allowed for lawyers who lecture on legal topics in community outreach programs.
