I am very concerned with the ethical implications and also the problems that may be ‘left’ with a practicing attorney if the case is not settled by the end of mediation. For example, discovery dates that may be missed. Overall strategy. Strategy in mediation where legal advice and opinion are often sought by clients. I do not believe it is in the public’s best interest to have ‘licensed’ paralegals.
Often mediation is not preferable until after discovery has been exchanged, or after temporary order hearings, and other motions before the court that take seasoned attorneys to advance a client’s objectives using all available legal means. The ‘praticing paralegal’ would not be able to perform all such actions and may limit the client’s ability to have his/her case furthered in an appropriate manner, leading to more time and costs.
