CJA03-111.Performance evaluation of active senior judges and court commissioners (AMEND)
Nonsubstantive clerical amendment to the title of the rule.

CJA04-510.04. ADR Training (AMEND)
The amendments: 1) ensure court-qualified Primary Trainers are actively involved in 40-hour basic mediation training; 2) require court-qualified mediation training providers to provide or facilitate opportunities for trainees to get the observation and experience requirements necessary to be admitted to the ADR Roster; and 3) make non-substantive formatting changes.

CJA04-202.12. Request by victim to use initials rather than name (NEW)
Under House Bill 102, for offenses occurring on or after July 1, 2026, a crime victim can choose to use their initials rather than their names in charging documents and other public-facing filings and documents. The amendments: 1) establish a process for victims to make a request; 2) require prosecutors to file a corrected charging document if a request is made after the charging document was filed; and 3) classify charging documents listing the victim’s name as “private” records pending the receipt of an amended charging document.

CJA03-110. Judicial officer financial disclosures (NEW)
New rule requiring all judicial officers to submit annual financial disclosures on a form approved by the Council.

CJA04-202.02. Records classification (AMEND)
The amendments: 1) classify court records identifying a victim by name rather than initials as “private,” if a valid and timely request is made under CJA rule 4-202.12, and 2) classify unredacted judicial officer financial disclosure forms as “protected records.”

CJA03-412. Procurement of goods and services (AMEND)
The amendments bring the rule in line with the Utah Procurement Code.

CJA04-102. Case, calendar, and panel assignments (AMEND)
In response to Senate Bill 257, the amendments direct district courts to assign any case or proceeding involving the same child or family to a single judge, to the extent possible.

CJA01-205. Standing and Ad Hoc Committees (AMEND)  
The amendments: 1) dissolve the Court Facilities Planning Committee, 2) amend the membership of the Uniform Fine Committee and the Committee on Children and Family Law, and 3) amend the membership of and certain provisions regarding the Guardian ad Litem Oversight Committee to coincide with amendments in House Bill 372.

Code of Judicial Administration – Effective May 1, 2025

CJA01-205. Standing and ad hoc committees (AMEND)
The amendments: 1) add community representatives who are knowledgeable about the needs of self-represented litigants to certain standing committees; 2) require the chair of each standing committee to conduct an assessment of the committee’s performance every three years and present those findings to the Management Committee; and 3) make non-substantive formatting changes.

CJA03-306.04. Interpreter appointment, payment, and fines (AMEND)
The amendments prohibit parties from asking court interpreters to provide on-the-spot interpretations of recorded evidence and on-the-spot translations of written documents during court proceedings.

CJA04-510.03. Qualifications of ADR providers (AMEND)
The amendments require that all applicants seeking to be included on the court roster as an arbitrator be a member of the Utah State Bar in good standing for at least ten years in order to qualify, removing alternative education, training, and experience options.

CJA04-613. Jail prisoner transportation (AMEND)  Non-substantive changes were made to rules 4-202.02, 4-510.06, and 4-613 in response to legislative recodifications.

CJA04-202.03. Records access (AMEND)
House Bill 129 amends adopted individuals’ right to access adoption records. Given the scope of the bill, the proposed amendments to rule 4-202.03 refer individuals to the statute to determine access to adoption records maintained by the court.

CJA Appendix A.  Justice Court Nominating Commissions Procedure Manual (AMEND)
The proposed amendments to Appendix A of the Code of Judicial Administration update justice court nominating commission procedures. Among other things, the amendments require applicants to use an online portal to be considered for a judgeship in justice courts and remove the credit check requirement.

CJA03-0306.02. Language Access Committee (AMEND). Removes the reference to rule Rule 3-306.05.

CJA03-0306.03. Interpreter credentialing (AMEND). Clarifies that the rule does not apply to staff interpreters employed by the court and gives the Language Access Program Manager the discretion to grant a rare language exemption without approval from the Language Access Committee.

Interpreter appointment, payment, and fees (AMEND). 1) Allows judicial officers to appoint “approved” interpreters in legal proceedings without exhausting the list of “certified” interpreters; 2) prevents court employees not hired as staff interpreters from interpreting legal proceedings; and 3) removes language regarding staff interpreter employee benefits.

Code of Judicial Administration – Effective May 1, 2016

CJA03-302 Clerk of Court. Amend. Provides that the clerk’s office shall be open during all business hours except Saturdays, Sundays, and holidays. Provides that during hours of operation the clerk or deputy shall be physically present, or immediately available remotely.

CJA03-306.01 Language access definitions. New. Defines terms applicable to rules 3-306.02 through 3-306.05 of the Utah Code of Judicial Administration. Deletions and additions to the language are redlined.

CJA03-306.02 Language Access Committee. New. Outlines the Language Access Committee’s responsibilities. Deletions and additions to the language are redlined.

CJA03-306.03 Interpreter certification. New. Outlines the process for becoming a certified interpreter. Provides a process whereby an exception may be made to one or more of the requirements as determined by the Language Access Committee. Reiterates the policy that contract interpreters are independent contractors. Deletions and additions to the language are redlined.

CJA03-306.04 Interpreter appointment, payment, and fees. New. Outlines the interpreter appointment process. Provides that the Judicial Council will review a market study every three years in order to set hourly rates for interpreters. Deletions and additions to the language are redlined.

CJA03-306.05 Interpreter removal, discipline, and formal complaints. New. Outlines the interpreter discipline process. Provides that an interpreter may be disciplined for unprofessional conduct, or for being convicted of, or charged with, a crime. Revises the formal complaint process so that following a proposed resolution by the Language Access Program Coordinator, an interpreter may request a hearing before a panel of the Language Access Committee, and may appeal that panel’s decision to the Language Access Committee. Deletions and additions to the language are redlined.

CJA04-106 Electronic conferencing. Amend. Authorizes the use of remote conferencing in lieu of personal appearances when certain requirements are met.

CJA04-408.01 Responsibility for administration of trial courts. Amend. Removes Morgan from the list of district courts administered by a county or municipality, since it is administered by the Administrative Office of the Courts.

CJA04-602 Victims’ Rights Committees. Repeal. Repeals the rule because the process for establishing Victims’ Rights Committees is now outlined by Utah Code section 77-37-5.

CJA09-105 Justice Court hours. Amend. Provides that during hours of operation, the justice court judge or clerk shall be physically present, or immediately available remotely.

CJA09-302 Mandatory electronic filing. New. Provides that e-filing will be discretionary in justice court criminal cases from July 1, 2016 to December 31, 2016. Provides that e-filing will be mandatory in justice court criminal cases beginning January 1, 2017.

CJA01-201 Membership – Election. Amend. Provides that Council members are not eligible to be voting members of a Board of Judges of a trial court.
