Rules of Criminal Procedure – Effective November 1, 2025

URCrP007.  Initial proceedings for class A misdemeanors and felonies. Amend. The amendments to Rule 7 feature both non-substantive formatting and language updates, and a substantive change adding a new subparagraph. State and federal law requires reporting certain information in protective orders to UCJIS and NCIS databases. In an effort to increase protections for crime victims, and to ensure the continuity of data regarding protective orders maintained at the state and federal level, Rule 7 now requires that at the commencement of a prosecution by information or citation, law enforcement agencies provide identifying information for the defendant to the court to include with any required or requested pretrial protective order.

URCrP007A. Procedures for arraignment on Class B or C misdemeanors, or infractions. Amend. The amendments to Rule 7A mirror those described for Rule 7.

Approved Amendments to Utah Rules of Criminal Procedure – Effective December 18, 2024

The Supreme Court’s Advisory Committee on the Rules of Criminal Procedure updated citations to the Utah Code in Rules 6, 7, 7A, and 9. The amendments do not include any substantive changes to the Rules.

Rules of Criminal Procedure – Effective May 1, 2018

URCrP007 Amend. The provisions in existing rule 7 are being divided into separate rules, each dealing with a different subject. Rule 7 will now address initial proceedings for class A misdemeanors and felonies.

URCrP007A New. The rule addresses procedures for class B & C misdemeanors and infractions. The rule also adds specific provisions on pretrial release conditions.

URCrP007B New. The rule addresses preliminary hearings. The rule generally reflects existing language.

URCrP007C New. The rule addresses the procedures for material witnesses. The rule generally follows existing language.

URCrP009 New. The new rule 9 will establish procedures for warrantless arrests. Of particular interest to practitioners may be the time-frames related to pretrial release decisions and deadlines for filing informations.

URCrP009A New. The rule creates procedures for arrests pursuant to a warrant and includes specific procedures on pretrial release decisions.
