Criminal Instructions – Comment Period Closes March 31st, 2024
The following instructions have been amended or created. The Committee requests public feedback on the proposed instructions:
CR1102 – Failure to Respond to an Officer’s Signal to Stop (3rd Degree Felony)
CR1103 – Failure to Respond to an Officer’s Signal to Stop (2nd Degree Felony)
Please reference the instruction(s) in your comments. Although these instructions are subject to a comment period, they are now ready for use. The Model Criminal Jury Instructions Committee will consider all comments made during the comment period and may revise the instructions as appropriate.
§ 41-6a-210 requires the person to be an “operator.” I recommend adding element 2 below to both CR1102 and CR1103: (I capitalized it for ease of reference)
1. The defendant, [defendant’s name];
2. WHILE OPERATING A MOTOR VEHICLE;
3. Knowingly received a visual or audible signal from a law enforcement officer to bring the vehicle to a stop; and
4. After receiving the audio or visual signal, [he], [she], [either]
a. Intentionally operated the vehicle in willful or wanton disregard of the signal so as to interfere with or endanger the operation of any vehicle or person; or
b. Intentionally attempted to flee or elude a law enforcement officer by vehicle or other means.
