Cap on Damages
Utah Code Section 78B-3-410 establishes a cap on non-economic losses in malpractice actions against health care providers. The statute requires the state treasurer to certify to the Administrative Office of the Courts annual adjustments based on inflation between July 1, 2002 and July 1, 2009. The statutory base adjusted for inflation as certified by the state treasurer between those years is reported here. Non-economic losses in causes of action arising on or after the dates specified are limited to the amount specified. The cap on non-economic losses in causes of action arising on or after May 15, 2010 is set by the legislature. See Section 78B-3-410 for details.
