Rules Governing the Utah State Bar – Admissions – Comment Period Closed November 24, 2025
USB14-702. Board – general powers. Amend. This amendment changes the title of the rule and clarifies that the process to request a rule waiver is found in Rule 14-722.
USB14-716. License fees; enrollment fees; oath and admission. Amend. This amendment allows the Office of Admissions at the Utah State Bar to file a fifth Motion for Admissions.
USB14-722. Rule Waiver. New. This new rule provides a process for applicants to seek a waiver of a rule from the Supreme Court.
Proposed Rule 14-722 could benefit from clarifying what procedures, if any, the applicant must follow before seeking a waiver. For instance, must they first obtain a denial of their application from Bar before seeking a waiver, or can an applicant seek a waiver regardless if, say, they subjectively believe they require a waiver? And to the extent the applicant must first submit an application for admission to the Bar, must the applicant still seek review from the Admissions Committee before seeking a waiver? And is there any timing requirement (e.g., within 30 days of when the application is denied or when the Admissions Board issues a decision)?
Assuming that the applicant can seek a waiver without first submitting an application or seeking review from the Admissions Committee, consider stating in the Rule that the applicant can seek a waiver without first doing those things.
