Amend.\u00a0<\/b>This amendment requires the factfinder to consider the presumptive sanctions set forth in the rules, along with any mitigating and aggravating factors. This amendment also adds a section to provide guidance\u00a0when multiple instances of misconduct are found.<\/p>\n<div><b><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-comment\/wp-content\/uploads\/sites\/31\/2022\/03\/Rule-11-583.Amend_.pdf\">RPP11-0583. <\/a>Imposition of sanctions. New. <\/b>This new rule provides presumptive sanctions to be imposed upon finding that the lawyer violated duties owed to clients, including candor, competence, diligence, conflicts of interest, and failing to preserve a client&#8217;s property and confidence.<\/div>\n<div><\/div>\n<div><b><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-comment\/wp-content\/uploads\/sites\/31\/2022\/03\/Rule-11-584.-New.pdf\">RPP11-0584. <\/a>Presumptive\u00a0sanctions for violating duties owed to the public. New.<\/b>\u00a0 This new rule provides presumptive sanctions to be imposed upon finding that the lawyer\u00a0failed to maintain personal integrity, generally, by committing a criminal act. Additionally, this new rule provides presumptive sanctions for violations of Rule 3.8, Special responsibilities of a prosecutor.<\/div>\n<div><\/div>\n<\/div>\n<div><b><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-comment\/wp-content\/uploads\/sites\/31\/2022\/03\/Rule-11-585.-New.pdf\">RPP11-0585. <\/a>Presumptive sanctions for violating duties owed to the legal system. New.<\/b> This new rule provides presumptive sanctions to be imposed upon finding that the lawyer has engaged in\u00a0conduct prejudicial to the administration of justice. This rule relates to deceit, fraud, misrepresentation, improper communication with individuals in the legal system, and abuse of the legal process.<\/div>\n<div><\/div>\n<div><b><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-comment\/wp-content\/uploads\/sites\/31\/2022\/03\/Rule-11-586.-New.pdf\">RPP11-0586. <\/a>Presumptive sanctions for violating duties owed as a member of the legal\u00a0profession. New.<\/b>\u00a0 This new rule provides presumptive sanctions to be imposed upon finding that the lawyer has engaged in conduct involving misleading\u00a0communications about a lawyer or a lawyer&#8217;s services, unreasonable or improper fees, unauthorized\u00a0practice of law, failure to report professional misconduct, and failure to respond to a lawful request from disciplinary authority.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>RPP11-0581.
