Resources supporting lawyer well-being are available through the Utah State Bar.&#8221;<\/div>\n<div><\/div>\n<div>The ABA has proposed\u2014but not yet adopted\u2014a comment to Rule 1.1 that contains permissive language tying lawyer well-being to competence (See Advisory Committee materials\u00a0<a title=\"https:\/\/legacy.utcourts.gov\/utc\/rulespc\/2023\/04\/06\/april-11-2022\/\" href=\"https:\/\/legacy.utcourts.gov\/utc\/rulespc\/2023\/04\/06\/april-11-2022\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/legacy.utcourts.gov\/utc\/rulespc\/2023\/04\/06\/april-11-2022\/&amp;source=gmail&amp;ust=1684446414530000&amp;usg=AOvVaw0ShMN8qTb0PIUgs_tf-J96\">here<\/a>). The above comment is Utah&#8217;s version of the ABA proposal.<\/div>\n<div><\/div>\n<div>The ABA and jurisdictions throughout the country have grappled with the question of how to de-stigmatize the topic of mental health in the legal profession. Utah has taken the bold step of making well-being resources, such as\u00a0<a title=\"https:\/\/unmind.com\/?locale=en_us\" href=\"https:\/\/unmind.com\/?locale=en_us\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/unmind.com\/?locale%3Den_us&amp;source=gmail&amp;ust=1684446414530000&amp;usg=AOvVaw36cxBpxeNWF1UJc6VsrxTi\">Unmind\u00a0<\/a>and\u00a0<a title=\"https:\/\/www.tavahealth.com\/\" href=\"https:\/\/www.tavahealth.com\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.tavahealth.com\/&amp;source=gmail&amp;ust=1684446414530000&amp;usg=AOvVaw1CLRyw10qc13Np_-cQVmpt\">Tava Health<\/a>,\u00a0readily available through\u00a0the\u00a0<a title=\"https:\/\/www.utahbar.org\/thriving-practice\/\" href=\"https:\/\/www.utahbar.org\/thriving-practice\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.utahbar.org\/thriving-practice\/&amp;source=gmail&amp;ust=1684446414530000&amp;usg=AOvVaw2iYFigQLqtjvamU3bYRH4d\">Utah State Bar<\/a>.<\/div>\n<div><\/div>\n<div>Comment 9 to Rule 1.1 takes this a step further\u00a0by explaining the nexus between well-being and lawyer competence. The addition is not meant to be punitive or impose additional requirements or burdens on lawyers.
