The proposed amendments would bring represented parties into the rule\u2019s purview. They would also permit any court to rely on another court\u2019s vexatious litigant findings and order their own restrictions.\u00a0<span style=\"color: #ff0000\">Paragraph (e)(1) was updated to fix a grammatical error.\u00a0\u00a0<\/span><\/p>\n<p>Rules Governing Constitutional Challenges<\/p>\n<p>The following amendments to <strong>Civil Rule 24<\/strong>,<strong>Criminal Rule 12<\/strong>, and <strong>Appellate Rule 25A<\/strong> \u00a0are intended to better coordinate the provisions addressing constitutional challenges. The amendments do the following:<\/p>\n<ul>\n<li>Address service on the Attorney General and other governmental entities;<\/li>\n<li>Broaden the kinds of challenges that may arise;<\/li>\n<li>Clarify that it is the governmental entity that responds, not the county or municipal attorney (which can be a contracted position in certain jurisdictions);<\/li>\n<li>Eliminate outdated language in Civil Rule 24 in favor of the updated federal language;<\/li>\n<li>Clarify in each rule the process and timing for the Attorney General or other governmental entity to respond to a constitutional challenge; and<\/li>\n<li>Eliminate the requirement in Appellate Rule 25A that the Attorney General state the reasons for declining to file an amicus brief.<\/li>\n<\/ul>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/URCP024-intervention-rules.Final_.Redline.pdf\">URCP024 &#8211; Redline<\/a> and <a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/URCP024-intervention-rules.Final_.Clean_.pdf\">URCP024 &#8211; Clean<\/a><\/p>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/URCrP012-intervention-rules.Final_.Redline.pdf\">URCrP012 &#8211; Redline<\/a><\/p>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/URAP025A-intervention-rules.Final_.Redline.pdf\">URAP025A &#8211; Redline<\/a><\/p>\n<p>Rules of Professional Conduct<\/p>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/RPC05.04.Final_.Redline.pdf\">RPC05.04.<\/a> <b>Professional Independence of a Lawyer.\u00a0<\/b>AMEND.<b>\u00a0<\/b>Adds a clarifying comment to the rule.<\/p>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/URCP-Rule-83-and-24-effective-5-1-21.pdf\">Supreme Court Order for Civil Rules 83 and 24<\/a><\/p>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/URCrP-Rule-12-effective-5-1-21.pdf\">Supreme Court Order for Criminal Rule 12<\/a><\/p>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/URAP-Rule-25A-effective-5-1-21.pdf\">Supreme Court Order for Appellate Rule 25A<\/a><\/p>\n<p><a href=\"http:\/\/legacy.utcourts.gov\/utc\/rules-approved\/wp-content\/uploads\/sites\/4\/2021\/01\/Order-Amending-Comment-RPC-5.4.pdf\">Supreme Court Order for Rules of Professional Conduct Rule 5.4<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rules of Civil Procedure URCP083.
