The 2015 amendments to Rule 37(e) of the Federal Rules of Civil Procedure address failure to preserve electronically stored information (ESI).\u00a0The committee invites public\u00a0discussion on this issue to inform whether or in what form a proposed rule amendment\u00a0should go to the Utah Supreme Court.\u00a0<i>The proposal has not been approved by the Utah Supreme Court.\u00a0<\/i><\/p>\n<p>Included with proposed Rule 37(e) is a memorandum that details some of the discussions\u00a0the committee has already engaged in on this topic as well as Federal Rule 37.<\/p>\n<p><strong><a href=\"https:\/\/legacy.utcourts.gov\/utc\/discuss-rules\/wp-content\/uploads\/sites\/37\/2017\/03\/URCP037.pdf\">URCP037(e).
