JUDGE MARY KATE APPLEBY

JUDGE MARY KATE APPLEBY - Judge Mary Kate Appleby is an Active Senior Judge. She was appointment to the Utah Court of Appeals in September 2014 by Gov. Gary R. Herbert. Prior to Judge Appleby's appointment, she was a Third District Court Judge for nearly eight years. Judge Appleby graduated from the University of Maryland in 1991, served as a judicial law clerk with the Maryland Court of Special Appeals, then joined the Maryland Public Defender's Office. She was an associate with the Salt Lake City law firm Anderson & Karrenberg from 1993 until 1996, when she became employed by the Office of Professional Conduct. Judge Appleby was the managing editor of the University of Maryland Law Review, the managing editor, then editor-in-chief of Voir Dire, and a member of the Executive Committee of the Utah Bar Journal. She was a member of the Board of District Court Judges and of the Grand Jury panel of judges, as well as the Utah Supreme Court`s Advisory Committee on the Rules of Civil Procedure. Judge Appleby currently serves as a member of the Judicial Council. She is a Fellow of the American Bar Foundation, a Convener of Dividing the Waters, a network offering resources for judges resolving water law conflicts, and an adjunct professor with the S.J. JUDGE RUSSELL W. BENCH

JUDGE RUSSELL W. BENCH - Judge Russell W. Bench is an Active Senior Judge. He was appointed in 1986 by Gov. Norman H. Bangerter as an original member of the Utah Court of Appeals. He took the oath of office in January 1987. After earning a law degree from the University of Utah College of Law in 1976, Judge Bench completed judicial clerkships for Chief Justice F. Henri Henriod and Chief Justice Gordon R. Hall of the Utah Supreme Court. Later, he served as a central staff attorney for the Utah Supreme Court. In 1985, Judge Bench earned his Master of Public Administration degree from Brigham Young University. Judge Bench served twice as the presiding judge of the Court of Appeals, as vice-chair of the Utah Judicial Council, as chair of various Judicial Council committees, and as a member of the Judicial Conduct Commission. While a senior judge, he has served on the Utah Independent Legislative Ethics Commission and as chair of the Davis County Ethics Review Commission. JUDGE MICHAEL G. ALLPHIN

JUDGE MICHAEL G. ALLPHIN - Judge Michael G. Allphin is an Active Senior Judge. He took the oath of office in July 1995 after being appointed by Gov. Michael O. Leavitt to the Second District Court where he served Davis, Morgan, and Weber counties. Judge Allphin received a law degree from the University of the Pacific, McGeorge School of Law in 1980. He practiced law in the Second, Third, and Fifth Districts with the firm of Boyack, Allphin & Hansen. He served as the State District Court Administrator during 1988 and 1989 and guided the District Court transition from county-operated to state-operated courts. He was appointed in May of 1989 as a District Court Commissioner in the Third District and later transferred to the Second District. He served in that assignment and as District Judge Pro Tempore until his appointment as District Judge. He also served as chair of the Executive Committee of Court Commissioners. He served as a member of the Board of District Court Judges from 1998 to 2004 and as chair of the board from 2002 to 2003. JUDGE JUDITH S.H. ATHERTON

JUDGE JUDITH S.H. ATHERTON - Judge Judith S.H. Atherton is an Active Senior Judge. She was appointed to the Third District Court in August 1995 by Gov. Michael O. Leavitt and served Salt Lake, Summit, and Tooele counties. Judge Atherton received a juris doctor from the University of Utah College of Law in 1983. She has served as staff counsel for the Legal Aid Society of Salt Lake and as an Assistant Attorney General in the Criminal Appeals Division. Judge Atherton has been co-chair of the Standing Committee on Children and Family Law, and served on the Committee for Improvement of Jury Service and the Board of District Court Judges. She was a member of the Commission on Criminal and Juvenile Justice and the Utah Judicial Council. She also sat on the Council's Management Committee. Judge Atherton was assigned to the criminal division of the Third District Court and, from 2004 to her retirement, supervised the Third District Mental Health Court, a calendar that addresses the needs of mentally ill defendants in the criminal justice system. JUDGE LYNN W. DAVIS

JUDGE LYNN W. DAVIS - Judge Lynn W. Davis is an Active Senior Judge. He was appointed to the Fourth Circuit Court in April 1987 and the Fourth District Court in June 1992 by Governor Norman H. Bangerter. He served Juab, Millard, Utah and Wasatch counties. Judge Davis received a law degree from J. Reuben Clark College of Law at Brigham Young University (BYU) in 1976. From 1976 to 1979, Judge Davis was in private practice and served as a deputy Utah County Attorney from 1979 to 1987. He is a past chair of the Board of Circuit Court Judges and past chair of the Board of District Court Judges. Judge Davis received the Utah State Bar Judge of the Year Award, the Excellence in Public Service Award, the Utah State Bar Distinguished Service Award, the Freedom of Information Award, and was named a 2007 Honored Alumnus at BYU. He served as the chair of the Utah State Court Interpreter and Translation Panel and also served on a national Advisory Committee on Court Interpretation. Updated 10/21/21

JUDGE GLEN R. DAWSON - Judge Glen R. Dawson is an Active Senior Judge. He was appointed to the Second District Court in September 1994 by Gov. Michael O. Leavitt where he served Davis, Morgan, and Weber counties. He received a law degree from the J. Reuben Clark College of Law at Brigham Young University in 1980. Judge Dawson served in Washington, D.C., as a trial attorney with the United States Department of Justice from 1980 to 1986. He relocated to Utah in 1986, where he served as an Assistant United States Attorney for the District of Utah until his appointment to the bench. Judge Dawson oversaw Mental Health Court for Davis County and was a member of the Utah Judicial Council. He is a current member and past president of the Rex E. Lee American Inn of Court. Judge Dawson is an Adjunct Professor of Law at the S.J. Quinney School of Law at the University of Utah in the Trial Advocacy Department and has also been an Adjunct Professor at Weber State University in the Criminal Justice Department. Updated 10/21/21

JUDGE DONALD J. EYRE, JR. - Judge Donald J. Eyre, Jr. is an Active Senior Judge. He was appointed to the Fourth District Court in November 1994 by Gov. Michael O. Leavitt and served Juab, Millard, Utah, and Wasatch counties. He received a law degree from the University of Utah College of Law in 1976 and was in private practice from 1976 until his appointment to the bench. Judge Eyre was appointed Nephi City Attorney in 1978 and concurrently served as Juab County Attorney from 1979 until his appointment to the bench. He served on the Jury Education Committee, the Justice Court Standards Committee, and the Children and Family Law Standing Committee. Judge Eyre served as the presiding judge of the Fourth District Court from 1999 to 2000, and on the Board of District Court Judges from 2000 to 2003. JUDGE DENNIS M. FUCHS

JUDGE DENNIS M. FUCHS - Judge Dennis M. Fuchs is an Active Senior Judge. He was appointed to the Third Circuit Court in December 1986 by Gov. Norman H. Bangerter. He became a judge in Third District Court in July 1996. He served Salt Lake, Summit, and Tooele Counties. He received his law degree from Boston University School of Law in 1973. He worked for the Law Enforcement Assistance Administration from 1974 to 1977. He was a Deputy Attorney in the Salt Lake County Attorney's Office from 1977 to 1981 and he was in private practice from 1981 to 1983. From 1983 to 1986, Judge Fuchs served on the Utah State Board of Pardons and was Chairman from 1985 to 1986. He was a member of the Supreme Court Ethics Advisory Committee has served on the Criminal Procedures Task Force and the Judicial Education Committee. JUDGE BEN HADFIELD

JUDGE BEN HADFIELD - Judge Ben H. Hadfield is an Active Senior Judge. He was appointed to the First District Court in March 1993 by Gov. Michael O. Leavitt and served Box Elder, Cache, and Rich counties. After graduating from the J. Reuben Clark College of Law at Brigham Young University in 1978, Judge Hadfield joined the Brigham City firm of Mann, Hadfield & Thorne and later became a partner in the firm. He was involved in numerous organizations, including service as president of the Brigham City Chamber of Commerce, president of Brigham City Kiwanis, and a volunteer with the Big Brother organization. A large percentage of his work as an attorney was in litigation. Judge Hadfield helped found the Rex E. Lee Inn of Court and is past president of the chapter, which focuses on professionalism and collegiality in the courtroom. In addition to his courtroom responsibilities, Judge Hadfield served on the Ethics Advisory Committee, the Board of District Court Judges, and the Utah Judicial Council from 2000 to 2003. Judge Hadfield served as presiding judge in the First District Court from July 2004 to July 2006. He then returned to the Board of District Court Judges and in September 2009 became chair of the board. Updated 10/21/21

JUDGE DAVID R. HAMILTON

JUDGE DAVID R. HAMILTON - Judge David R. Hamilton is an Active Senior Judge. He was appointed to the Second District Court in July 2010 by Governor Gary R. Herbert. He serves Davis, Morgan, and Weber counties. Judge Hamilton received a law degree from the University of Utah, School of Law in 1978 after completing a bachelor's degree at the University of Utah in 1975. Prior to taking the bench, Judge Hamilton was in private practice for 32 years, most recently as a solo practitioner at David R. Hamilton, P.C. His practice concentrated in insurance defense, collections, family law, and mediation. For more than 10 years, Judge Hamilton has been the chair of the Fund for Client Protection (Client Security Fund) with the Utah State Bar. JUDGE ROYAL I. HANSEN

JUDGE ROYAL I. HANSEN - Judge Royal I. Hansen is an Active Senior Judge. He was appointed to the Third District Court in July 2003 by Governor Michael 0. Leavitt, and served as the Presiding Judge from 2011 to 2015. The Utah State Bar selected Judge Hansen as Judge of the Year in 2012 and as a multi-year recipient of the Judicial Excellence Award. In 2016, he was named the third Utah Judge to receive the Peacekeeper Award in recognition of his commitment to the process of peace and conflict resolution. In 2013, he was recognized with the Distinguished Pro Bono Service Award. Judge Hansen is a fellow of the American Bar Foundation. He currently serves as the chair of the Judicial Council's Alternative Dispute Resolution Committee, as co-chair of the Utah State Bar Pro Bono Commission, and as vice president of the Utah Bar Foundation. Judge Hansen previously served as a commissioner on the Utah Judicial Conduct Commission. He is the founding judge of the South Valley Felony Drug Court (2005) and the Utah Veterans Treatment Court (2015). Judge Hansen received a law degree from the University of Utah College of Law in 1975. He was a law clerk for Judge Frank Q. Nebeker of the District of Columbia Court of Appeals from 1975 to 1976. Judge Hansen was a partner with the law firm of Moyle & Draper from 1976 to 2003. He was admitted to practice in the District of Columbia and Utah. Judge Hansen is a member of the Aldon J. JUDGE ERNEST W. JONES

JUDGE ERNEST W. JONES - Judge Ernest W. Jones is an Active Senior Judge. He was appointed to the Second District Court by Gov. Michael O. Leavitt in August 2000 where he served Davis, Morgan, and Weber Counties. Judge Jones received a law degree from the University of Utah School of Law in 1974. He was the Clinton City attorney, worked at the Utah Attorney General's Office, the Weber County Attorney's Office, and the law firm of Olmstead, Stine and Campbell. Judge Jones was employed with the Salt Lake County District Attorneys Office (1980 to 2000) at the time of his appointment to the bench. Judge Jones received the Most Valuable Prosecutor Award and Salt Lake County Employee of the Year award while employed by the county. Judge Jones is LTC (Ret.), Staff Judge Advocate, U.S. Army Reserves, 87th LSO, Ft. Douglas. He served on the Supreme Court's Advisory Committee on Criminal Jury Instructions and was a member of the 2003 Judicial Conference Planning Committee. JUDGE THOMAS L. KAY - Judge Thomas L. Kay is an Active Senior Judge. He was appointed to the Second District Court in June 1998 by Gov. Michael O. Leavitt where he served Davis, Morgan, and Weber counties. Judge Kay received a law degree from Brigham Young University in 1979 where he served as a Note and Comment Editor of the BYU Law Review. After a 1 1/2 year clerkship with U.S. District Judge David K. Winder, he maintained a civil trial practice with Ray, Quinney & Nebeker and Snell & Wilmer until his appointment to the bench. Judge Kay served on the Utah Supreme Court's Advisory Committee on the Rules of Professional Conduct, was a mediator in U.S. District Court, and a judge pro tem in the Third District Court. He has served in the Litigation Sections for the American Bar Association; and on the committee on Professional Liability Litigation of the American Bar Association. Judge Kay is the Associate Presiding Judge in the Second District. He is a Master of the Bench for the Rex E. Lee American Inn of Court. Judge Kay currently serves on the Utah Supreme Court Advisory Committee on Evidence, the Jury Improvement Committee, the Alternative Sentencing Committee, and the Board of District Court Judges. JUDGE GORDON J. LOW - Judge Gordon J. Low is an Active Senior Judge. He was appointed to the First District Court in 1987 by Gov. Norman S. Bangerter and served Box Elder, Cache, and Rich counties. After receiving his Juris Doctorate at Arizona State University in 1973, he joined the law firm of Hillyard & Gunnell as an associate and later became a partner. Judge Low is a former member of the Commission on Justice in the 21st Century. He is a past chair of the Board of District Court Judges, the Judicial Conduct Commission, and the Utah Judicial Standing Committee on Education. JUDGE MICHAEL D. LYON - Judge Michael D. Lyon is an Active Senior Judge. He was appointed to the Second District Court in July 1992 by Governor Norman H. Bangerter and served Davis, Morgan, and Weber counties. Judge Lyon served twice as presiding judge of the Second District Court. He also served on the Utah Judicial Council, the Governor's Child Support Guidelines Advisory Committee, and as a member and chair of Utah's Board of District Court Judges. He was founding president of the Rex E. Lee American Inn of Court, an organization dedicated to promoting ethics and professionalism within the legal profession. Before becoming a district judge, Judge Lyon was the justice court judge for South Ogden City and practiced law with the law firm of Lyon, Helegesen, Waterfall, & Jones in Ogden, where his practice emphasized civil litigation. He is a former Clinton City attorney and deputy Weber County attorney. He is also a past member of the Ethics & Disciplinary Committee and the Courts and Judges Committee of the Utah State Bar. Judge Lyon received his B.S., cum laude, from Weber State College and his J.D. degree from the University of Utah in 1971. In 2013, he received the Utah State Bar's Judge of the Year Award. JUDGE EDWIN T. PETERSON - Judge Edwin T. Peterson is an Active Senior Judge. He was appointed to the Eighth District Court in September 2009 by Governor Gary R. Herbert. Judge Peterson served Daggett, Duchesne, and Uintah counties and was the Eighth District Court presiding judge. He served as Deputy Uintah County Attorney prior to his judicial appointment. He also served as an Assistant Utah Attorney General in the Child Protection Division, a Pro Tem District Court Judge in the Third Circuit Court in West Valley, and as the Murray City Prosecutor. Prior to serving as a prosecutor, he was in private practice in Salt Lake County. After law school and admission to the practice of law, Judge Peterson served four years active duty as a Captain in the U.S. Air Force as a Judge Advocate. JUDGE SANDRA N. PEULER

JUDGE SANDRA N. PEULER - Judge Sandra N. Peuler is an Active Senior Judge. She was appointed to the Third District Court in May 1994 by Gov. Michael O. Leavitt. She received a law degree from the University of Baltimore in 1977, and is a member of the Maryland State Bar and the Utah State Bar. Prior to her appointment, Judge Peuler was a court commissioner in Third District Court for 12 years. She is a former member of the Children's Justice Center Advisory Board, the Utah State Bar Ethics Advisory Opinion Committee, and the Board of District Court Judges. Judge Peuler served on the State Commission on Criminal and Juvenile Justice from 1998 to 2006. She is a past-president of the David K. Watkiss-Sutherland II Inn of Court, and served as associate presiding judge and presiding judge for the Third District Court from 2001 through July 1, 2007. She is a Fellow of the American Bar Foundation. Judge Peuler received an award of special recognition from the Utah State Bar in 1992 for her work as a court commissioner. JUDGE ROBIN W. REESE - Judge Robin W. Reese is an Active Senior Judge. He was appointed to the Third Circuit Court in March 1987 by Gov. Norman H. Bangerter. He became a judge in Third District Court in July 1996 and served Salt Lake, Summit, and Tooele Counties. Judge Reese received his law degree from the University of Utah College of Law in 1980. He was an attorney in the law firm of Tibbals, Adamson, Peters & Howell from 1980 to 1981, and a Deputy Salt Lake County attorney from 1981 until his appointment to the bench. Judge Reese served as a member of the Supreme Court Advisory Committee on the Rules of Criminal Procedure, as presiding judge of the Third Circuit Court from 1992 to 1995, and as associate presiding judge of the Third District Court from 1995 to 2001. Prior to his appointment to the bench, he was a senior shareholder/director with the law firm of Richards, Brandt, Miller & Nelson. Judge Stott is also a member of the Wyoming Bar Association and past president of the Central Utah Bar Association. Judge Stott has served as the presiding judge of the Fourth District Court and was a two-term member of the Judicial Council. JUDGE JAMES R. TAYLOR - Judge James R. Taylor is an Active Senior Judge. He was appointed to the Fourth District Court in February 1999 by Gov. Michael O. Leavitt where he served Juab, Millard, Utah, and Wasatch counties. Judge Taylor presided over an adult Drug Court in Utah County from 2002 until his retirement. He was named Adjunct Professor of the Year for the School of Business at UVSC in 2006. Judge Taylor was previously the presiding judge for the Fourth District Court and served on the Board of District Court Judges. Judge Taylor was a Joseph Fielding Smith Scholar at Brigham Young University in 1973. He graduated from the University of Utah College of Law in 1980. JUDGE THOMAS L. WILLMORE - Judge Thomas L. Willmore is an Active Senior Judge. He was appointed to First District Court in January 1999 by Gov. Michael O. Leavitt where he served Box Elder, Cache, and Rich counties. Judge Willmore graduated from Utah State University and received his law degree from the University of Pacific McGeorge School of Law. JUDGE L. KENT BACHMAN - Judge L. Kent Bachman is an Active Senior Judge. He was appointed to the First and Second District Juvenile Court in August 1977 by Gov. Scott M. Matheson. He received his law degree from the University of Utah College of Law in 1968. Judge Bachman was a Deputy Weber County Attorney and Chief Deputy City Attorney for Ogden City. He was in private practice from 1968 to 1977 in general civil and criminal litigation and during this time and was a referee for the First District Juvenile Court from 1969 to 1971. Judge Bachman was the chair of the Board of Juvenile Court Judges from 1981 to 1982 and again from 2004 to 2005. Judge Bachman is a former member of the Judicial Council. He has served on the state court re-districting committee which resulted in the creation of the eight judicial districts. He also served on the Uniform Fine and Bail Committee and the Family and Juvenile Court Committee considering the creation of a family court. Updated 10/21/21

Judge Heward earned her Juris Doctors from the University of Utah in 1987 and a Bachelor of Arts degree from Weber State University in 1982. Judge Heward started her legal career in private practice in Ogden, then worked as a deputy Weber County attorney with her primary assignment in juvenile court. She subsequently earned the rank of full professor and taught criminal justice at Weber State University in both the undergraduate and graduate programs for 15 years. During a portion of that time she also served as a justice court judge in Riverdale and South Ogden cities. She presides over a Family Drug Court, serves as a member of the Utah Judicial Council, Utah Youth Court Committee, Children's Justice Center Community Board, and Communities That Care Key Leader Board. JUDGE KIMBERLY K. HORNAK - Judge Kimberly K. Hornak is an Active Senior Judge. She was appointed to the Third District Juvenile Court in October 1994 by Gov. Michael O. Leavitt where she served Salt Lake, Summit, and Tooele counties. Judge Hornak received a law degree from Gonzaga University College of Law in 1983. From 1984 to 1985, Judge Hornak was a staff attorney with Utah Legal Services in Ogden. From 1985 to 1986, she was a staff attorney with the Legal Aid Society. Judge Hornak was assistant attorney general from 1986 to 1988, and Deputy Salt Lake County Attorney from 1988 until her appointment to the bench. She has taught in the Trial Advocacy Program at the University of Utah College of Law and for the paralegal program at Westminster College. JUDGE FREDERIC (RIC) M. ODDONE - Judge Frederic (Ric) M. Oddone is an Active Senior Judge. He was appointed to the Third District Juvenile Court in August 1994 by Gov. Michael O. JUDGE SCOTT J. CULLIMORE - Judge Scott J. Cullimore is an Active Senior Judge. He served as a judge for the Utah County Justice Court for 21 years. Judge Cullimore graduated from Brigham Young University with a degree in Criminal Justice and retired from a career in law enforcement after 20 years of service. Prior to his appointment to the bench, Judge Cullimore worked as a supervisor for the Department of Adult Probation and Parole. He also worked as a correctional officer at the Utah State Prison, a driver's license examiner for the Department of Public Safety, a psychiatric aid at the Utah State Hospital, and a field investigator for the Department of Assistance Payments. Judge Cullimore has taught substance abuse classes for the Utah County Department of Human Services. He has been a member of the Advisory Board of Adult Probation and Parole and has been a member of the Lindon Historic Committee.
